Terms of Service

1. Acceptance of Terms

By accessing or using NOWWWA ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and NOWWWA.

2. Description of Service

NOWWWA is an AI-assisted software development platform that allows users to describe, generate, preview, and deploy web and mobile applications. The Service uses third-party AI models (currently Anthropic and OpenAI) to produce code and related artifacts based on user input. Features available to you depend on your current subscription plan. The Service includes, among other things:

  • The builder — conversational generation, preview, and publishing of your product.
  • Agent Loop — an optional autonomous mode in which the AI runs a bounded, unattended sequence of build/review turns against your project without your review of each individual step. See Section 5 for what this means for your responsibilities.
  • Brain OS — a set of specialist AI agents that generate business-facing documents (strategy, branding, marketing, legal, accounting, and workforce planning documents) grounded in your project. See Section 5 for important limits on what these documents are.
  • Expert Chat and scheduled sessions ("Hire NOWWWA Team") — live or asynchronous support from NOWWWA-affiliated developers, which may involve those developers viewing or, where you request it, directly modifying your project's code. See Section 5.
  • Connections — linking your own accounts (such as payment, calendar or social media accounts) to a project, sending a project's events to web addresses you choose (outgoing webhooks), and a WhatsApp contact button for your site. See Section 5.

3. User Accounts

You must be at least 18 years old to create an account and use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. NOWWWA reserves the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use the Service to generate, store, or transmit content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You may not attempt to reverse-engineer, disrupt, scrape, or gain unauthorised access to any part of the Service or its infrastructure. Violation of these restrictions may result in immediate account termination.

Your own face and voice. In Content you may use your own face and your own voice in what you create, and only your own: you may not upload, record or use the face or voice of any other person, including a public figure, and you may not use your own to pass yourself off as someone else. By setting them up you confirm that you are over 18, that you are the person photographed or recorded, and that you hold the rights to the photo or the recording. They are used only for content you make in your own account, and you can delete them at any time. If you use this feature with another person's face or voice, or to mislead, we may remove the content, turn the feature off for you, and suspend or terminate your account (Section 7).

Photos of real people. You may not use a photo you upload to animate a real person, put words in their mouth, or change their face or body, without their consent. In Content, a photo you upload with a recognisable person in it is never animated or redrawn: with the consent of everyone in it, you may only remove or replace its background, or make it sharper. We check the pictures you start from and refuse what this does not allow; misuse is handled under Section 7.

5. Intellectual Property, Autonomous Actions, and Generated Business Content

Code and other output generated through the Service is owned by you, subject to any third-party licences that may apply to underlying libraries or AI-generated content. You are responsible for ensuring that your use of generated output complies with applicable laws. NOWWWA retains all rights to its platform, branding, interface design, and proprietary technology. Nothing in these terms transfers ownership of NOWWWA's intellectual property to you.

  • Agent Loop. When you start Agent Loop, you authorise the Service to make a bounded series of changes to your project without your review of each individual step. You choose when to start and stop it, and you remain solely responsible for reviewing, testing, and securing the resulting code before relying on it or deploying it — the same as any other generated output (Section 10).
  • Brain OS documents. Strategy, branding, marketing, legal, accounting, and workforce documents produced by Brain OS are AI-generated drafts grounded in the information available about your project. They are not legal, financial, tax, or professional advice, and are not a substitute for review by a qualified lawyer, accountant, or other professional before you rely on them — this applies in particular to any legal document (such as a terms of service or privacy policy) the Service drafts for your own business.
  • Expert Chat and human support. If you start a live chat, book a scheduled session, or engage "Hire NOWWWA Team", you authorise NOWWWA-affiliated developers to view your project's code and content, and — only where you explicitly request it — to make changes to your project directly, in order to provide the support or work you asked for.
  • Connected accounts and outgoing webhooks. When you connect one of your own accounts to a project, you authorise the Service to use that access to do what you ask in that project, and you confirm that you are allowed to grant it. You can disconnect it at any time: NOWWWA then deletes the access it stores, and you may also need to remove NOWWWA's access in the provider's own settings. When you add an outgoing webhook, you choose where the project's events are sent, and you are responsible for that address and for what the receiving service does with the data. Connecting accounts is available on paid plans; outgoing webhooks and the WhatsApp button are available on every plan.

6. Subscriptions, Credits, and Billing

NOWWWA operates on a subscription model with included generation credits per billing period. The following terms apply:

  • Subscriptions are billed monthly or annually, according to the billing cycle you choose at checkout. Upon cancellation, you retain full access to your plan's features until the end of the current billing period. No partial refunds are issued for unused days.
  • Credits are consumed when you run AI generation tasks. Unused credits are not forfeited upon cancellation — they remain in your account and continue to be usable until depleted, even after your subscription ends.
  • Refunds are not provided except where required by applicable law, including EU consumer protection regulations. If you believe a charge was made in error, contact us within 14 days.
  • Pricing is subject to change. We will provide at least 30 days' notice of any price changes before they take effect on your subscription.

7. Account Termination

You may cancel your subscription at any time through Settings → Billing. To delete your account, email hello@nowwwa.ai from the address registered to your account; we delete it within 30 days of your request.

  • Cancelling a subscription stops future billing and moves your account to the free plan at the end of the current billing period. Your credits are preserved. The free plan includes one active project: if you have more, the one you updated most recently stays active and the others are archived and their published sites taken offline. Projects archived this way may be permanently deleted at any time after 7 days unless you upgrade and restore them; we email you the list of affected projects and the date. Custom domains are disconnected.
  • Deleting your account permanently deletes your account, projects, and associated data, and takes your published sites offline. This action is irreversible. Any active subscription will be cancelled as part of this process and no refund is issued for the remaining period. Billing records are kept for as long as tax law requires, as described in our Privacy Policy.

NOWWWA may also terminate or suspend your account immediately if you breach these terms, engage in fraudulent activity, or cause harm to the Service or other users.

8. Referral Programme

You can invite others to NOWWWA with your personal invitation link, found in the account menu under Invite & earn, and earn credits when the people you invite become paying customers. The following terms apply:

  • How rewards are earned. When someone creates their NOWWWA account through your link and pays for their first plan, and that plan is Pro, Max or Ultra, they receive a one-time credit bonus with that first payment, and you receive a credit reward. Nothing is earned for a sign-up alone, for a free account, for a Starter plan, or for a purchase of credit packs. The number of credits is the one shown on the Invite & earn page when the invited person pays.
  • Who can be invited. A person can be invited only once, by the first valid invitation link they open, and only if they create their account within the period shown on the Invite & earn page, counted from when they opened the link. Someone who already had an account, or who has paid us before, cannot be invited.
  • When your reward is granted. Your reward waits for 14 days after the invited person's payment — to the end of the fourteenth day — and is granted only if, at that point, the payment is real and has not been refunded, disputed, or otherwise reversed. Until then it is shown as waiting.
  • Monthly limit. Each account can receive a limited number of rewards per calendar month, shown on the Invite & earn page. A reward above the limit waits and is granted in the following month.
  • Clawback. If the invited person's payment is refunded before your reward is granted or within 7 days after it is granted, or is disputed with the card issuer at any time, the reward is cancelled or taken back, and so is the invited person's bonus. Credits are taken back only up to each account's balance, never below zero.
  • Self-referral and abuse. You may not invite yourself — through another account, another email address, or a payment made with a card you use — and only one reward is paid for payments made with the same card. Rewards obtained through fake, automated, or bought sign-ups, spam, or misleading promotion are forfeited: waiting ones are cancelled, granted ones may be taken back, and the accounts involved may be suspended under Section 7.
  • No cash value. Credits earned through the programme have no cash value. They cannot be exchanged for money, transferred, or sold, and are used like any other credits (Section 6).
  • What each side sees. The person who invites sees each of their invitations as a number ("Invited #n"), with its status and dates to the day — never the invited person's name, email address, or payment details. The invited person is not told whose link they used. See our Privacy Policy.
  • Changes and ending. We may change the programme's amounts and rules, pause it, or end it at any time; the Invite & earn page always shows the rules in force. Rewards already waiting for payments made before a change, pause, or end are honoured under the rules that applied when the payment was made.

9. NOWWWA Lite

NOWWWA Lite, at lite.nowwwa.ai, is a simpler NOWWWA for people who work by appointment: a website with bookings, requests from clients, and posts, made and changed with AI. These Terms apply to it in full; where this section says something different for NOWWWA Lite, this section applies.

  • The plan. NOWWWA Lite has one plan, paid monthly or yearly, at the price shown before you pay, in lei or in euro; the price shown is the price you pay. On either billing cycle the plan includes 80 credits every month. Credits are used by the AI's work, such as a post, a change to your site or a new page. Credits left at the end of a month do not carry over to the next month.
  • Credit packs. With an active NOWWWA Lite plan you can also buy packs of credits. Pack credits are valid for 12 months from your most recent pack purchase.
  • Renewal and cancelling. The plan renews automatically at the end of each period until you cancel it. You can cancel at any time from My account; the plan then runs to the end of the period you have paid for, after which its monthly credits stop. Except under the right of withdrawal below, no refund is given for the rest of a period.
  • Right of withdrawal. If you are a consumer, you may withdraw from the purchase of the plan or of a pack within 14 days of the purchase, without giving a reason. Because NOWWWA Lite starts as soon as it is paid, before each payment we ask you to tick a box by which you ask us to start straight away and acknowledge the following. For the plan: you lose the right of withdrawal for the credits you use, and if you withdraw within the 14 days you pay an amount in proportion to what we provided until you told us, namely the days of the plan that have passed and the credits you have used; we refund the rest within 14 days of receiving your notice. For a pack: you lose the right of withdrawal once its credits are in your account. To withdraw, email hello@nowwwa.ai from the address registered to your account within the 14 days. The right of withdrawal does not apply to purchases made for your business.
  • Confirmation. After you buy the plan or a pack, we email you a confirmation that repeats the box you ticked.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. NOWWWA does not guarantee that generated code is error-free, secure, or fit for production use. You are responsible for reviewing, testing, and securing all output before deploying it.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NOWWWA and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of or inability to use the Service. Our total aggregate liability to you for any claim arising from use of the Service shall not exceed the amount you paid to NOWWWA in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless NOWWWA and its affiliates from and against any claims, liabilities, damages, losses, and expenses — including legal fees — arising out of or in any way connected with your use of the Service, your violation of these terms, or your infringement of any third-party rights, including intellectual property rights related to code you generate and deploy.

13. Changes to Terms

NOWWWA reserves the right to modify these terms at any time. For material changes, we will provide at least 14 days' notice via email or an in-app notification before the changes take effect. Your continued use of the Service after the effective date of revised terms constitutes your acceptance of those changes. If you do not agree to the revised terms, you must stop using the Service and may terminate your account.

14. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. Any disputes arising from or relating to these terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Romania. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.
